These Terms and Conditions govern orders placed through durexa.com. Please read them before submitting an order. Mandatory consumer rights are not excluded or restricted by these Terms.
1. Scope
(1) These Terms apply to contracts concluded through the DUREXA online shop between the operator identified in the Legal Notice (“DUREXA”, “we”, “us”) and the buyer (“you”).
(2) A consumer is an individual acting mainly for purposes outside their trade, business, craft or profession. A business buyer acts for commercial or professional purposes.
(3) Additional or conflicting conditions proposed by a buyer apply only where we expressly accept them in writing.
2. Contracting Party and Contact
Your contract is made with the legal operator of DUREXA. Full provider particulars must be entered on our Legal Notice page before publication.
Email: contact@durexa.com
Website: durexa.com
3. Conclusion of Contract
(1) The display of goods on our website is an invitation to place an order and is not, by itself, a binding offer.
(2) By selecting the final order button, you submit a binding offer to buy the merchandise shown in your basket.
(3) An automated acknowledgement confirms receipt only. Unless the acknowledgement expressly accepts the order, acceptance occurs when we send a dispatch confirmation or ship the goods, whichever happens first.
(4) We may decline an order before acceptance, including where stock is unavailable, payment authorisation fails, pricing is clearly incorrect or delivery restrictions apply.
(5) The contract language is English. Order records are retained in accordance with our legal and accounting obligations.
4. Prices and Shipping Costs
(1) Prices are displayed in the currency shown at checkout and include applicable VAT where the website states that VAT is included.
(2) Delivery charges and any available free-shipping threshold are shown before the order is submitted.
(3) Buyers receiving goods outside the United Kingdom may be responsible for import VAT, customs duty, handling charges or similar costs imposed by local authorities.
5. Payment Terms
(1) Available methods may include Visa, Mastercard, American Express, PayPal, Klarna, Apple Pay, Google Pay and bank transfer, subject to availability at checkout.
(2) Payment is due when the order is placed unless a payment provider offers an approved deferred-payment arrangement.
(3) Third-party payment services may apply their own conditions and eligibility checks. We do not receive or retain complete card security details.
6. Delivery
(1) Goods are sent to the address supplied at checkout. You must check that the address is complete and accurate before placing the order.
(2) Delivery estimates are not guaranteed dates unless expressly stated otherwise. We will contact you where a significant delay becomes known.
(3) Risk passes to a consumer when the goods come into the physical possession of the consumer or a person nominated by them, other than the carrier.
(4) Events beyond our reasonable control may extend fulfilment times. This does not affect statutory cancellation or refund rights.
7. Retention of Title
Ownership of the goods remains with us until the total amount due for the relevant order has been paid in cleared funds.
8. Right of Cancellation for Consumers
Consumers buying at a distance generally have a statutory right to cancel within fourteen days, subject to legal exceptions. Full instructions and the model form appear in our Cancellation Policy & Returns page.
9. Warranty and Liability for Defects
(1) Goods must be as described, of satisfactory quality and fit for any purpose made known to us where applicable under mandatory consumer law.
(2) Nothing in these Terms limits rights under the Consumer Rights Act 2015 or other mandatory legislation.
(3) Please report faulty, damaged or incorrectly supplied goods promptly to contact@durexa.com, including the order number and supporting photographs where helpful.
10. Liability
(1) We do not exclude or restrict liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or breach of mandatory consumer rights.
(2) For business buyers only, and to the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, revenue, anticipated savings, goodwill or business opportunity.
(3) We are not responsible for loss caused by inaccurate details supplied by the buyer or by events outside our reasonable control.
11. Dispute Resolution
Please contact us first so that we can try to resolve any concern. The former European Commission Online Dispute Resolution platform has been discontinued and is therefore not presented as an available complaint route.
We do not commit to participation in a consumer arbitration scheme unless required by applicable law.
12. Applicable Law and Jurisdiction
(1) These Terms are governed by the laws of England and Wales. A consumer retains the benefit of mandatory protections of the country in which they habitually reside where those rules cannot lawfully be displaced.
(2) Consumers may bring proceedings in any court that has jurisdiction under applicable consumer law. Business disputes are subject to the exclusive jurisdiction of the courts of England and Wales unless agreed otherwise in writing.
13. Final Provisions
If any provision is held invalid or unenforceable, the remaining provisions continue in effect. A failure to enforce a right immediately does not waive that right. Amendments apply prospectively from the date published unless the law requires otherwise.
